1. Acceptance of Terms
Welcome to Volta. These Terms of Service ("Terms") govern your access to and use of Volta's charging stations, mobile application, website, and any other services provided by Volta (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you may not access or use the Services.
2. Changes to Terms
We may modify these Terms at any time. If we make changes, we will provide notice of such changes, such as by sending an email notification, providing notice through the Services, or updating the "Last Updated" date at the beginning of these Terms. Your continued use of the Services following notification of changes will constitute your acceptance of such changes.
3. Using Our Services
3.1 Eligibility
You must be at least 18 years old and capable of forming a binding contract with Volta to use our Services. By using our Services, you represent and warrant that you meet these requirements.
3.2 Account Registration
To use certain features of our Services, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for all activities that occur under your account.
3.3 Charging Station Use
When using our charging stations, you agree to:
- Follow all posted instructions and safety guidelines
- Use the charging equipment only for its intended purpose
- Not damage or tamper with the charging equipment
- Move your vehicle promptly after charging is complete
- Pay all applicable fees for your charging session
4. Payments
By using our charging services, you agree to pay all charges at the rates in effect when the charges are incurred. You agree that we may charge your payment method for all amounts due for your use of the Services. All fees are non-refundable unless otherwise stated.
5. Intellectual Property
The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Volta, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
6. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Volta, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Services, including any direct, indirect, special, incidental, consequential, or punitive damages.
7. Indemnification
You agree to defend, indemnify, and hold harmless Volta, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.
8. Governing Law
These Terms and your use of the Services shall be governed by and construed in accordance with the laws of Poland, without giving effect to any choice or conflict of law provision or rule.
9. Dispute Resolution
Any legal action or proceeding relating to your access to, or use of, the Services or these Terms shall be instituted in the courts of Warsaw, Poland. You and Volta agree to submit to the jurisdiction of, and agree that venue is proper in, these courts in any such legal action or proceeding.
